Tenant Can’t Afford To Pay For Damage

Landlord Question:

We have tenants who broke their ceramic/glass cooktop. They want to replace it by installing a new one themselves. We are concerned about their safety due to the large crack in the cooktop. Our rental agreement says that they need to pay because of their own negligence. They are also section 8 housing, so they don’t have money available right now. Can/Should we make them replace it and have them pay us back on monthly installments? What would be the best solution?

 

Attorney Response:

The tenant is responsible for the damage.  I would suggest that you have a qualified person make the repair and charge the tenant.  If you reach a payment agreement with them, have them sign a non-waiver agreement each time they make a partial payment.
