South Dakota rental property owners, landlords and property managers need to use rental agreements and legal notices to follow the South Dakota landlord tenant laws. Should you decide to use a different lease, listed below are terms and conditions you should include to help you meet the minimum requirements.

NOTICE PERIOD TO TERMINATE TENANCY:

One month

RENT INCREASE NOTICE:

One month

SECURITY DEPOSIT LIMITS:

One months’ rent (higher deposit may be charged if special conditions pose a danger to maintenance of the property)

NOTICE PERIOD FOR TERMINATION FOR NONPAYMENT:

3 days landlord can use an Unconditional Quit

NOTICE PERIOD FOR TERMINATION FOR LEASE VIOLATION:

Landlord can file evict ion lawsuit immediately, without giving tenant opportunity to cure, if tenant violates a lease clause that provides for immediate termination upon violation

NOTICE FOR UNCONDITIONAL QUIT:

3 days—non-payment of rent, substantial damage, holdover

LATE CHARGES:

No statutory limit
