Oregon rental property owners, landlords and property managers need to use rental agreements and legal notices to follow the Oregon landlord tenant laws. A free, state-specific Oregon lease is included in your ARPOLA membership along with the Oregon legal notices and forms you will use most often. Should you decide to use a different lease, listed below are terms and conditions you should include to help you meet the minimum requirements.

NOTICE PERIOD TO TERMINATE TENANCY:

30 days for occupants of one year or less

60 days for occupants of more than one year (but only 30 days if property is sold)

Temporary occupants are not entitled to notice

RENT INCREASE NOTICE:

30 days for occupants of one year or less

60 days for occupants of more than one year (but only 30 days if property is sold)

Temporary occupants are not entitled to notice

SECURITY DEPOSIT LIMITS:

No statutory limit

NOTICE PERIOD FOR TERMINATION FOR NONPAYMENT:

3 days but notice cannot be delivered until rent is 8 days late

6 days but notice cannot be delivered until rent is 5 days late

NOTICE PERIOD FOR TERMINATION FOR LEASE VIOLATION:

14 days to cure; additional 16 days to vacate; 10 days to remove an illegal pet

NOTICE FOR UNCONDITIONAL QUIT:

24 hours*

LATE CHARGES:

Landlord must wait 4 days before assessing a late fee and must disclose the late fee policy in the rental agreement; a flat fee must be “reasonable”; a daily fee may not be more that 6% of the reasonable flat fee and cannot add up to more than 5% of the monthly fee
